Solutions to rising crimes against women & children.

The recent report by Praja highlights what has been suspected all along that crimes against women & children are treated casually.. This explains the fact, that, more than 90% cases are pending trials in courts.

Hence, conviction is less than 40 % .The reasons can be many. One major reason is shortage of manpower or rather human power. The highest shortage is in forensic laboratories where its 40%, followed by public prosecutors where its 28% shortage. Next is the police, where shortage of personnel is 18% & in sessions courts, the shortage is 14% .Even the Supreme Court & High Courts have vacancies & it takes years to fill up the vacancies. Obviously, all this affects deliverance of justice .And ,when ,at the grassroot level, there are vacancies at sessions courts, & amongst the police, the public prosecutors, & in the forensic laboratories, women & children continue to suffer as their lives are marred by violence.

Even in cases that needed to be tried under the Prevention of Children from Sexual Offences ( POCSO) Act ,just about half of the cases have been tried in special courts as mandated under the POCSO  act. And only 44 out of a total 220 cases tried under POCSO reached the stage of judgement in 2019. In, 2020 , because of COVID, the situation has definitely worsened. All this will add to a huge backlog of cases in the future.

As per the National Judicial Data Grid ,the backlog of cases is a whooping 37.7 million ! This works out to 3.7 million cases pending for 10 years, Out of these 3.7 million cases, 2.8 million cases before the district courts & 0.92 million cases before the High Courts have remained pending. And that’s not all. Nearly, 6,60,000 cases have remained pending for more than two decades & another, 1,31,000 have remained unresolved for more than 30 years. All this adds to a huge economic cost. Moreover, delay in justice is as good as denial of justice.

Capital punishment or death penalty is an incorrect response to check crimes against women & children. Capital punishment is not a deterrent .It is an expensive process & since nearly 75 % of the accused on the death row are from the marginalised sections of society, it gets too exorbitant .And death penalty has not acted as a deterrent .If death penalty is the answer then murders should have stopped. And yet, murders continue. Capital punishment is like revenge & this has therefore no place in a civil society. And cases in which capital punishment is awarded take years to end. And this makes it a long & winding process. It is traumatic for the victim, their families & even for the accused & their families. .And where is the scope to correct if a person is given capital punishment & later its discovered that the accused who suffered the death penalty ,had not committed the alleged crime ?

Many states have brought in the death penalty in case of sexual assaults' of children below 12 years under POCSO. And the effect is ,that there are hardly any convictions. Because ,in most cases of sexual abuse of children , the accused   ( more than  90% ) are from the family and friends. And so the victim or survivor is pressurized to keep silent & not depose against the accused.

The pandemic has led to an exponential increase in cases of domestic violence .And even in such cases, it is  likely that the women who are the victims and survivors , will choose to remain silent .They would rather not speak up against their family members. So death penalty will make this complaining against family members nearly impossible.

Faster arrests , thorough investigation & fast tracking of cases  is needed to curb rising crimes against women & children.

How can the pendency of cases involving women & kids be  brought down ? Obviously by decisions of the courts .And that can happen only when the courts function with full capacity. That means all vacancies need to be filled up. And this should include vacancies at the levels of judiciary, at the level of police , at the level of public prosecutors and also at the level of forensic laboratories. It's the entire gamut of the judicial system that needs to be covered.

Another step that needs to be taken is to fill up all the vacancies that exist across all the courts, from  the lowest till the highest levels. This will improve the judge to population ratio & help in brining down the backlog of cases. The Advocate General of India, Mr Venugopal recently told the Supreme Court that there is a lot of gender bias in the judiciary .He opined that as many as 50 % of judges need to be women to make it non biased.

A suggestion is to temporarily increase the number of lower courts by appointing willing law graduates as judges .Such temporary judges will be paid only salary .They will be ineligible for other benefits .And as soon as the backlog of cases end, these temporary  judges will be retired without any benefits. Of course, the most suitable of them can be absorbed into the judicial services after the requisite examinations & interviews & other relevant criteria. And mostly these temporary judges can be from women candidates. Even the courts which have to try POCSO cases can be headed majorly by women. Because women have a better understanding of children & their trauma. The temporary judges can try a majority of the cases dealing with women & children as women are better equipped to deal with such cases.

The Supreme Court guidelines as laid down in the Vishaka case  ( which dealt with sexual harassment at the workplace ) stated that the internal complaints committee in any organisation must be headed by  a woman .At least half of the members of this committee must be women. It follows therefore that women must have an equally importantly role to play in violent crimes affecting women & children

Similarly, other temporary posts can be created across the entire gamut of the criminal justice system whereby police personnel, the public prosecutors, the forensic team, can be majorly women. And these temporary posts can be ended once the pendency of cases gets back to manageable proportions. Here also, the most suitable ones can be absorbed into the permanent services through examinations, interviews & other relevant criteria. The Constitution of India allows reservation in favour of women & hence these judicial, police , public prosecution & forensic science jobs in favour of women are as per the Fundamental Right under Article 15 ( 3 ).

Another  way to reduce the huge backlog of cases is to allow  the courts & other judicial & quasi judicial authorities to work in shifts.  In Maharashtra, the lower courts will be working in two shifts .And this, is indeed, the urgent need of the day. In fact, not just the lower courts, even the High Courts & Supreme Court need to work in shifts to clear the huge backlog of cases. If this happens, the backlog will end soon & then all courts can resume single shift working.

And as women get employed , the GDP of our country will rise by 27 % .Hence, employing women as judges, police personnel, public prosecutors & forensic scientists will be a WIN WIN situation for all !!! It will make the society safer for women & children as crimes are dealt with promptly & justice is delivered. Economy will improve & the backlog of cases will reduce.

And this is in accordance with India’s position on the international stage. India is signatory to the International Covenant on Civil & Political rights as also Convention for Elimination of Discrimination against Women .

And this pandemic has given us a chance to implement the aforesaid ideas ,  which can only lead us ahead in the direction of a better tomorrow !

Women & the four pillars of Justice.

This blog post was published as a featured post on Women's Web. Featured Posts are a careful selection of highly relevant and interesting posts picked by  editors @Women's Web .each day

The Times of India dated 7th of November, 2019 published a study  " Litigants lose nearly ₹ 50,000 crore annually in  India " .The report went on to say that all states & Union Territories s spend less than 1% of GDP on judiciary .Delhi is the only state which spends 1.9 % of GDP on judiciary. The average for India works out  to 0.8% of GDP on judiciary. The score by the states on the four pillars of justice namely legal aid, judiciary, police & prison is equally pathetic.

The represenation of women in judiciary is slightly more than one fourth, at 26.5 % whereas in the police it is merely 7 % & for prisons, it is slightly better at 10 % .Because the number of women lawyers is less, the empanelment of women is even lesser. Only  Tamil Nadu ,which had a good number of women in the judiciary & police,  came out on top in diversity. Diversity helps the cause of justice.

The India Justice Report , 2019  says that vacancies in police, prison & judiciary is the main cause of delay in justice. And denial of justice over long periods  leads to economic  loss & may lead to social unrest & instability . Prisons are overcrowded except jails for women. Legal aid looks like a cruel joke  as it is pegged at only 75 paise on a per capita basis every year.

Women are caregivers & caretakers .So its better to utilise them in areas such as prison reforms & even in police & the judiciary.Women are the sensitised lot & are more responsive  than men in cases of rapes of women, children, etc.Even today , the POSCO act is rarely invoked to punish the accused in the cases of child rapes. This would change ,if women are in charge . So, the need of the times, is more women in the workforce. A beginning ,can be made by increasing the number of women in the lower strata of the police, prisons & the judiciary. Over time, these ladies from the lowest ranks can move to higher ranks in the respective fields . Since women are less in the work force , appointing them at the higher levels without relevant experience would seem unfair & may be unworkable.

The percentage of women in the workforce is less than 25 %.There are many reasons .One is patriarchy as women are supposed to manage home & hearth. Safety is another factor .And because, there are few women in work force , there is lot of gender disparity in  wages, in both informal  as also the formal workforce.

Hence ,more women need to be brought into the work force. And they need to do paid work not housework. This will increase India's GDP by 20 % as per one estimate .

In another study by two Harvard students, it was found ,that more women in workplace would lead to a rise of nearly 27 % in the GDP of India. There is lot of discrimination which happens during hiring ,over qualifications, experience, etc. So the need is to increase gender diversity, to get more women into doing paid  work.

Unfortunately, in India, the women are leaving paid work & sitting at home taking care of family & housework. This ,in spite of higher GDP & higher employment .As women  get better educated & get married into higher income families, they give up paid work because of socio cultural reasons. The Government wants women to take an increased role in the armed forces & yet ,there's lot of resistance. A silver lining has been the commissioning of flight commander S. Dhami as Flight Commander in the officer cadre .Lieutenant Commander Karabi Gogoi has been selected as the Assistant Naval Attache at Russia. She is a naval engineer & at present is posted at Karwar naval base, Karnataka.Lets trust, this the beginning ,of a long line of female officers in the Armed  Forces.

Similarly, government should enforce that more women are at work in the police, prisons & the judiciary  .Though private companies can do their bit in hiring more women , government can set the finest example, by making it easy, to hire women.  Women in correctional services & law & order services would lead to better safety environment for all ,especially for women, children & the elderly. And hence ,better law & order promoting peace. As the number of women increase in the judiciary, the police &  the prisons, legal aid  will get utilised to help the underdogs . This will lead to amore equitable society.  This will lead to stability, in which India can prosper faster, leading to better living conditions for all .

Since vacancies in judiciary are more at lower rungs,as high as 52 % in Mizoram  it would suffice if women are employed on contactual terms initially .This would ease burden on the exchequer .
Because shortly & surely, women would  set up such a high bar that there they would earn their place/ s in the aforesaid services .And the number of judges at subordinate courts need to rise too .In India, there is one judge for 50,000 people. This needs to improve. So more judges are needed at subordinate courts .And the courts need to work in shifts ,as there are lakhs of cases pending in courts .This shift working will help clear the backlog of pending cases. This will help in employing more women as well.

.Just like in the local self governments, there is reservations for women , even at lower rungs in judiciary, police & prisons, 50 percent  or more jobs  can be reserved for women .This is allowed by Indian constitution under Fundamental Rights.Article 15 ( 3 ) of the Constitution allows reservation in favour of women. Moreover, India is a signatory to the Convention for Elimination of Dicrimination Against  Women . India has also signed the International Covenant on Civil & Political Rights .

The women need to have a bachelor's degree in law .With this basic degree , they can dispense justice at lower rungs with some basic training thrown in. A similar plan can be drawn up to employ more women  in the police & prison services. The best among the women so employed, must be given chances to rise up in the services. Soon, there will be more & more women breaking the glass ceilings. Obviously, the percentage rise in India's GDP will the cream on the cake !

And as more women participate in the labour market by doing paid work, gender parity in wages will become better & better. And  gender equality will lead to better family life, less stress, better health & a society that has does not judge on masculanity. In short, better living conditions for all !

Movie Review : Article 15

"We became Harijan (  Mahatma Gandhi used to address dalits as people of God , Harijan ) or bahujan ( many people ) but we never became the people, "says the activist. And so the dalits remain marginalized in our Bharat & never mainstream.

The film Article 15 by director Anubhav Sinha  is overflowing with such innumerable dialogues which are right on spot .And there are many scenes, which are symbolic of what is happening in our nation .Article 15 is a fundamental right under the Indian Constitution. It prohibits  discrimination & allows for reservations  for upliftment of the scheduled castes, scheduled tribes, women & children.

This film is said to be inspired by the hanging of two girls in north India. A young IPS ( Indian Police Service ) appointee, Ayaan ( Ayushmann Khurana )  is posted to a  small town in north India. On the first day of his posting , he is prevented from meeting a group of  dalits as his juniors tell him that these people are forever complaining about sons & daughters who go missing & then return later. .He meets his team & the contractor  who is  in charge of setting the toilet in the police chowki . The contractor says that a new commode will be put as the old one has become useless ...symbolic of swachh Bharat. Can a toilet signify cleanliness & that too, in every aspect ?

And the toilet muck keeps dirtying  the police chowki throughout the film symbolising  the quicksand of dirt & muck surrounding the nation's  police force. The political  parties have used the police forces to fulfill their agendas thereby politicizing the police & ruining the reputation of the police. So much so, that the protectors have turned perpetrators .

The two missing girls are found hanging the next day ,early morning before Sunrise .The bodies are sent for post mortem .The lady doctor who is doing the post mortem is under tremendous pressure for obvious reasons. The police force personnel are non chalant about the death of the girls & keep informing their boss, the young IPS that whatever we may do for them, it hardly matters. A furious Ayaan demands to know , "Who are they ? "It is as if even mentioning the names of the marginalized would pollute them.

Ayaan talks to his writer activist wife about the case & she is all ears. The wife is his voice of conscience & he promises that he will do his best .Ayaan is trying to understand why even half a century after we gained  independence, casteism continues to ruin the nation.

Were the girls raped ? Can the higher castes rape girls from lower castes even as the higher ups declare that its a sacrilege to  drink or eat anything touched by the untouchables  ? Crimes are   always between unequals....the powerful perpetrator/ s & the hapless victim/ s. And a female & that too dalit, means doubly helpless .And a male & from  upper social echelon means doubly dangerous .... even fatal.

There are parallel tracks of a dalit neta who is a rebel & his love interest. There is another track about an upper caste leader teaming up with the disadvantaged taking undue advantage of the coalition. The coalition wins & yet,  can it remain viable, when casteism is lurking beneath the surface ? Ayaan also meets his college friend  who works for the government for another department. He goes missing & his phone is off as well. Ayaan asks his team to find his missing friend. Where is he & what has become of him ?  What happens to the young fire brand leader who has gone underground ? Does he get his due ?

Amidst all this, the IPS officer is subject to an enquiry as he asked about the caste of his police  team members. He is alleged to be partisan .He is suspended. Will he continue with his investigation ? And where will it lead to ? Will the dead girls get justice ?

All the actors have acted well. Even the tiny role essayed by Isha Talwar as the IPS officer's wife is portrayed well. The director Anubhav Sinha deserves kudos for highlighting the problem of caste politics & hopefully, the country should start talking about how we can all resolve  casteism.

And as the young neta says, "More people die in gutters than at the borders...." The film depicts that we all have conspired to remain silent even as we see the marginalised being pushed down deeper . We want the disadvantaged to remain stuck in the muck , so  that the most unwanted work  like manual scavenging, deskinning dead animals & the like is done by them.

And unless, the marginalized are brought into the maintsream vide  upliftment through reservations , & other means , there cannot  be Sabka Saath, Sabka Vikas.

Book Review : Ri :The Homeland of Uncertainty

Ri -Homeland of Uncertainty is a movie in Khasi which has been adapted in the form of a book by Paulami Duttagupta.

This is the story of what Meghalaya went through from 2000 to 2004.Shillong ,the present capital of Meghalaya has got a cosmopolitan nature with its music festivals, fashion streets ,delicious cuisine etc.All that was changing thanks to terror. This is a fictional account of the pain & horror of the phase that lasted for some time.

This is the story of Kyndiah, the police chief who is trying hard of rid the Shillong public of the fear of terror. He has to answer journalists like Janet who feel that police is trampling on human rights in the name of fighting terror. It is also the tale of many who are drawn into the cesspool of terror who take up guns & kill .Maybe not kill & yet assist in killing thereby  spreading the atmosphere of fear. Why does  Manbha feel any regret when he hears that a trader has been killed ? And yet,he feels that his land should be freed from outsiders.Manbha feels that he is a freedom fighter & not a terrorist. Is he right when he says he has not killed anyone himself.Even aiding a terrorist is the same or maybe it is not.Manbha finds that all this is getting too heavy on his conscience.Yet,will he surrender ? Will the police accept his surrender & forget what he did earlier ? Maybe the police will kill him in encounter & claim to have busted a terror racket.Manbha is lost.He feels guilty & yet he cannot come back to his family .This the story of so many like Manbha who take up arms after being brainwashed by separatist groups. Is Kyndiah a police officer who fakes encounters ? Why does he throw himself in the line of fire before his men ? Who is Emika & how does she speak so authoritatively ?Who wins ? Terror or peace ? And how ?

The author has depicted the dilemma of the innocents who have taken up arms & joined terrorism. This dilemma makes the reading very engrossing. There is never a  dull moment in the book. The helplessness of innocents who  join ,& cannot turn back.;They are lonely. They have no life. And they have to dance as per the instructions of the commanders. The author has managed to sneak in some wry humour in the angst ridden tale. And special kudos for drawing attention to the terror scene in the North east of our country !

Voting

Yesterday ,was the polling day in my city.Schools& offices were closed .I had received my voting slip. This voting slip is a xerox copy of my voter identity card. I am yet to receive my voter identity card.

I wanted to desperately vote this  time.Maybe, because I felt ,it was my duty or maybe I wanted my candidate to at least win the number of votes which will assure that he gets back his deposit from the Election Commission.

I left with my parents quite early in the morning by around seven thirty.

The polling booth was  in a nearby school. As we started walking to the polling booth,we spotted many youngsters sitting on chairs with tables in front. They were sitting outside our housing complex. They had booklets with names of voters on the tables & were busy in verifying names etc.We came across many such young people at work at some more places on our way. This is good, as the young ones are on the streets, doing something worthwhile.

We reached the school which was our polling booth centre. There were policemen posted in the premises. There was also a police jeep waiting outside the school gate with some more policemen.

We spotted two queues. We stood in the queue. My dad was told to join the queue for gents .He joined .He was pushed to the front as he is a senior citizen. This was done by the police constables who checked our voter slips.Someone started a row as to why some senior citizens are being pushed in front. The constables on duty understood  that this is kaliyug .Hence from then onwards, senior citizens just joined the queue without being pushed to the front. While all this,  was going on ,my mom had been pushed ahead in the queue as she too is a senior citizen. My parents finished their voting duty & came out.I asked them to return home.I was still some way behind.

Then ,the police constables said to the men in the gents queue to push ahead a little. Some men objected. They were of the opinion that gents queue must have been on the side  where ladies were standing as male voters were more & that ladies side was more airy. The constables decided to keep mum from then on.Some people are never happy with whatever arrangement id done. They will find faults galore, even if they were in utopia !

Finally ,my chance came.I showed my voter slip.My name was there in the voter's list .My finger was inked.I had to sign .Then I was directed to the enclosure where I could press the button.I pressed the red round button .Nothing happened. Then I pressed the blue elliptical shaped button. The red light blinked. My vote had been registered.I walked out & returned home !

I was thrilled that   after  many fruitless years of trying to get registered as a voter,I had managed to vote after successful registration !

Book Review :The Price You Pay.

Somanth Batabyal,a young author ( his snap is on the penultimate page ) has authored a racy tale in the novel "The Price You Pay ".The book's cover design shows a night scene with police sirens & a police officer in the shadows stands out.The publisher is Harper Collins .The paper quality is good & printing is very neat. The price is Rs.350 & the novel is of 285 pages.

This is the story of Abhishek Dutta who joins a newspaper, the Express. His stories make heads turn & how ! Is he really good or is lady luck smiling on him ? There is Amir ,his boss who is a very respected name in press circles.Uday Kumar is DCP,Delhi who is from the state cadres & resents cops from the Central Cadres.Uday & Amir are very close. There is Mayank Sharma , a young officer in the police department who reports to Uday Kumar & yet he feels that his boss is not right, many a times.

Delhi is the backdrop of this novel. The crime & politics of Delhi make for this thriller.Press & police are feeding off each other.Press is eager for stories & the police act as if they cannot part with information.Sometimes,it is the police who plant stories which leads to hilarious results.

The daily grind at the press office & the attitudes of the police are captured in the pages of the novel. One feels that one must join the press or the police as they both are full of action....always on the move. There is never a dull moment.Of course ,there are risks and yet one feels the adrenalin rush as we follow the story.

There is a dreaded kidnapper Babloo Shankar & his girlfriend. That he has arrived in India is a rumour or is it true ? Abhishek is unsure & yet he knows, this will make front news.

Abhishek joins television & is soon disillusioned. How does he make up for it ? Will he shine like when he was in the press ? Is Samir Saxena able to pacify Abhishek to continue his tint with television ?

Is Babloo Shankar in India ? If so ,what is on his mind ? Why is the police not doing anything to arrest Babloo Shankar if he is in India ?

The protagonist Abhishek Dutta is vulnerable like all of us & still takes risks .So the reader is with Abhishek & we want him to be the winner.Does Abhishek win though he is a commoner &  without a godfather ? What happens to Babloo ? Does Abhishek return to the Press or  continues with the television  industry with its obsession with TRPs & little else ?

There is some underlying humour in the story like crores of rupees packed in a cheap suitcase which just confirms that Indians only can resort to such ideas...the bag may give away anytime ! Why waste money on a suitcase ...so what if crores are put in it ? The author's statements spoken through his characters makes one think though they  may be politically incorrect. The corruption at the Commonwealth games finds mention in the novel .So also terrorism ,shootouts, shooters, corruption for visas, driving licenses & the like.A novel rooted in present day Bharat. Especailly Delhi, the rajdhani of India.

The saga makes it clear that the press & the television are addicted with stories which  get maximum readership & viewings. So they will go to any  extent  to achieve that.Though sometimes, they are forced to stop or retreat for obvious reasons.

I would recommend this book to all who want to read a good thriller.I was egged on by the writing to read more & more pages of the book.An engrossing read....quite real.

Indifference.

Yesterday, the daily, reported that a woman was gangraped & burned by her spurned lover & his brothers & friends. This happened in a slum with none of the neighbours noticing anything or even hearing anything. The time was evening -just after sunset.

One can only think of the callous indifference of the neighbours & that too in such a crowded area. Moreover,it was not that it was midnight & all were deep in slumber & still, the accused ran away after setting her ablaze ! Really, this has all happened due to our collective apathy. But then how are you & me concerned ? We are, maybe not in this case directly, but surely, in some indirect manner. This apathy is what is so prevalent in a city like Mumbai where we all stay in matchboxes huddled together but care a damn about what happens next door.We keep crying for space -for privacy.

In a way,we are glad ,aren't we that there in so little a space, we learn about a death in our neighborhood from the Obituary column in the newspapers ?How does it bother us - a death,an accident ,a rape,a molestation et al ?It is only somebody else's problem & the police has to deal with it.But, even the police, need witnesses but, then, why waste our precious time & energy in such mundane matters ?

The problem with this approach, is that, other also think alike when a problem strikes me home & then I have to deal with it alone as I left them alone to deal with their problems.Unless,we collectively take up cudgels against such goondaism or for that matter in solving our problems ( not my problems, mind you),such episodes will continue.Even the State can be goaded into action only, when we all urge it to do so as a team -as a team has strength unlike one person. So let us share ,help & work together so that our Government, our netas can be made to serve us & not the other way around. Then only will we be kaamyaab. Then, we can sing in chorus,"Hum honge kaamyaab,..."
